Mandelbaum Barrett PC, PC announces that, after six years of litigation in the United States District Court for the Southern District of New York, it settled a nationwide overtime collective and a New York Rule 23 class action brought against a major telecommunications company. The plaintiffs are former retail account executives who had been deemed exempt from the overtime laws. The settlement, which was approved by the Court, provides $1.9 million to the class members plus attorney’s fees. The company, which has not admitted any liability, denied the allegations in the case. The parties elected to settle to avoid continuing legal expense and the uncertainty of a trial. Michael A. Saffer, Co-Chair of the Firm’s Litigation Department, and Steven I. Adler, Co-Chair of the Firm’s Labor and Employment Department, handled the case with partner Arla D. Cahill and associate Brian M. Block.
