Vito is a seasoned family lawyer who successfully represents clients in all aspects of family law, including post-judgment and pre-judgment divorce matters, custody, alimony, business valuations, child support, equitable distribution, enforceability of prenuptial agreements, and domestic violence issues. Vito has experience in litigating matrimonial matters through completion of trial but frequently pursues alternative dispute forums such as mediation and arbitration. Vito handles matters across the state of New Jersey, appearing regularly in counties such as Monmouth, Middlesex, Ocean, Essex, Union, Bergen, Hudson, Somerset, and Hunterdon.

Vito has practiced exclusively in the area of family law since his graduation from Seton Hall University School of Law school. After graduation from law school, Vito clerked for the lead matrimonial judge in Essex County, Hon. Michael R. Casale, J.S.C. (ret.) After completion of his clerkship, Vito practiced family law at a boutique firm in Summit, New Jersey where he represented clients in high-profile divorces, including financial executives, business owners, attorneys, and other professionals, as well as the spouses of these individuals.

As an experienced attorney, Vito serves as an Early Settlement Panelist in Essex and Union counties where he volunteers his time to assist in resolving pending matrimonial matters in the Court system.

Vito’s approach to the practice of law is to advise all his clients the same way he would if they were his family. His representation of a client differs from case to case, consistent with what he believes are the best interests of the client in that particular case. He does not believe that one approach fits every case and prides himself on taking the time to truly get to know his clients and assess what works for their circumstance and goals.

Vito has been recognized to the Rising Star list by New Jersey Super Lawyers from 2018 through 2022.* Vito has served as Co-Chair of the Young Lawyers Subcommittee of the New Jersey State Bar Family Law Executive Committee since 2020 and previously served in the role as Education and Technology Co-Chair for the Young Lawyers Subcommittee in 2019-2020.

You Can’t Return an Agreement Like You Can Ugly Sweaters

December 28, 2023

In Negron v. Benitez, the Appellate Division rejected a plea to reconsider a custody-modifying consent order, citing no significant changes in just four months. The case illustrates common "buyer's remorse" in family law. If entering agreements this holiday season, beware—they might endure, and the difficulty of undoing terms is costly, time-consuming, and likely burdensome.
