Cheryl Burstein successfully defended an appeal of a judgment granting possession of commercial space where the former tenant argued that the special civil part lacked both personal jurisdiction over the defendant and subject matter jurisdiction. The appellate division rejected the former tenant’s arguments of improper service of process; that the Tenant did not surrender possession; and that the Lease’s option to purchase provision caused the Special Civil part to no longer have jurisdiction.
