• The Firm’s Labor & Employment Law Practice led by Steven Adler won a trial in January, 2018 in the United States District Court for the Southern District of New York.  The Firm defended Russo Realty Company on a withdrawal liability claim brought by the Trustees of a multi-employer pension plan.  The Trustees initially claimed the Firm’s client was liable for the amount owed to the pension alleging Russo Realty was a business under common ownership and control as the entity having liability which had filed for bankruptcy.  After the Firm’s team of attorneys established in discovery that Russo Realty was not under common ownership and control, the Trustees amended their Complaint to allege that Russo Realty was an alter ego of the other company.  At trial Mr. Adler proved Russo Realty also was not liable under that theory and our client avoided liability of approximately $3.25 million.  Stuart Gold assisted Steven Adler on this matter.
  • On March 2, 2018 the Practice Group’s attorneys settled a case filed in Delaware for its client Asta Funding, Inc., a publicly traded diversified financial services company, in which Asta claimed it was owed money under multiple, account servicing agreements relating to the collection of consumer debt.  The case settled for $4.35 million.  The case was handled by Steven Adler and Lauren Topelsohn.
